Can the developer increase the price after I sign the SPA?

Once you sign the sale agreement, the price in that contract is the price. New buyers may pay more in a later phase, but your own contract price does not move unless the agreement itself allows it. Here is what to check before you sign.

No, not as a general rule: the price written in your signed sale agreement (SPA) is the price you owe, for the unit and the specifications described in that contract. A developer raising prices for new buyers in a later release does not reach back into contracts already signed. If you are seeing higher prices advertised for the same project a few months after you reserved, that almost always reflects new buyers paying a new phase price, not a change to your own agreement.

Why launch prices rise without touching existing contracts

Off-plan projects are typically sold in phases, and later phases are often priced higher than earlier ones as construction progresses and the remaining inventory shrinks. Our guide on why prices rise between launch phases explains the mechanics. This is a separate process from your contract: a price increase for phase three of a project does not amend the agreement a phase-one buyer already signed.

What could actually change your price

The contract price itself is fixed, but a few clauses, if present in your specific SPA, can change what you end up paying for reasons unrelated to the headline price:

  • Surface area adjustments. Some contracts include a clause reconciling the price if the final built area differs from the plan at handover, within a tolerance stated in the contract.
  • Specification or variation changes. If you request a change to finishes or layout after signing, that is a separate agreement with its own cost, not a unilateral price increase.
  • Fees that sit alongside the price. The Dubai Land Department registration fee and any Oqood or developer administration fee are additional to the unit price from the start; they are not a later increase to it.

None of these are a developer unilaterally raising your contract price; they are specific, contract-defined situations that should be stated clearly in the SPA you sign.

What to check before you sign

Before signing, read the clauses on price, surface area tolerance and any variation process carefully, and ask your adviser to point them out if they are not obvious. Our guide on what to check in the SPA before signing covers this in full, including the clauses worth asking a lawyer to review.

FAQ

Can the developer simply decide to charge me more later? Not under the price agreed in your signed SPA. A later price increase applies to new buyers in a new phase, not to contracts already in force.

Why do I see a higher price for the same project online now? That is typically a new sales phase priced higher than the one you bought into, which our guide on why prices rise between launch phases explains in detail.

Could the final size of my unit change the price? Some contracts include a surface area reconciliation clause tied to the final built area at handover, within a stated tolerance. Check whether your SPA includes one before you sign.

What should I do if I am unsure about a price-related clause? Ask your adviser to walk through the clause with you, and have a lawyer review the full sale agreement before you sign, particularly anything touching price, surface area or variations.
