What happens if the developer is late in Dubai?

Your money is not exposed the way it would be with an unregulated deposit: it sits in an escrow account the developer only draws on against certified progress. Here is what a delay actually changes, and what does not move.

A delay does not put your payments at risk the way it would if you had simply wired money to a developer's operating account. In Dubai, every off-plan payment goes into an escrow account opened for that specific project and controlled by the Dubai Land Department. The developer can only draw on it as construction milestones are certified, so a late project is a late project, not a lost deposit. What actually changes when handover slips is the timeline in front of you, and what your sale agreement says about that timeline is worth reading before you sign, not after.

What the sale agreement actually promises

The completion date in an off-plan contract is an anticipated date, not a guaranteed one. Every project we present, whether it is Sanctuary Residences at Meydan Horizon or any other, lists its handover as "on request" or "confirmed by your adviser" rather than a fixed date we quote ourselves, precisely because a fixed date implies a promise the developer has not made in writing to us. What the contract does specify, and what your adviser reads with you line by line, is the grace period the developer is allowed before a delay counts as a breach, and what remedy the contract provides if that threshold is crossed. Those clauses differ by developer and by project, so we do not summarise them into one universal rule; we point you to the exact wording in your document.

How you can track progress yourself

You are not dependent on the developer's word for how a project is actually going. The Dubai Land Department runs a Project Status Enquiry service that lets you check the registered progress of an off-plan project at any time, from any country. It is the same tool your adviser checks before recommending a project, and it is worth bookmarking once you have reserved, so that any concern you raise with your adviser is grounded in the DLD's own record rather than rumour.

If a delay becomes a dispute

Dubai's real estate regulator, RERA, and the Dubai Land Department oversee off-plan sales, and disputes over delayed handover go through the mechanisms set out in your sale agreement and in UAE real estate regulation, not through an informal arrangement with the developer's sales office. We are not a law firm and we do not draft your remedy for you; what Orven does is confirm, before you sign, that the project is properly registered, that the escrow account is active, and that the delay and termination clauses in the contract are ones you actually understand, so that if a delay happens, you are not reading those clauses for the first time under pressure.

What an Orven adviser checks before you reserve

We confirm DLD registration and an active escrow account for the project, we read the anticipated completion date and the grace period language with you, and we tell you plainly if a project's disclosed progress on the DLD's own service looks inconsistent with its sales pitch. If you already own an off-plan unit and want a second opinion on where a project stands, write to us on WhatsApp at +971 52 776 1939 or at sales@orvenproperties.com with the project name, and we will check the public record with you.

FAQ

Can I get my money back if the developer is late? It depends on the grace period and termination terms in your specific sale agreement. Your adviser reads that clause with you before you sign, so you know the answer for your contract, not a generic one.

Is my payment safe if the project stalls? The funds sit in an escrow account controlled by the Dubai Land Department, released to the developer only against certified progress, which is a materially different position from an unregulated deposit.

How do I check on construction progress myself? Through the Dubai Land Department's Project Status Enquiry service, using the project's registration details, which your adviser can also walk you through. See what Oqood is for how the registration itself works.
