What is musataha in Abu Dhabi?
Musataha is a renewable right of use and construction, typically granted for 50 years, distinct from full ownership. Here is what it actually gives you, and what still needs confirming on the SPA.

Musataha is one of the real estate regimes recognised in Abu Dhabi: a right of use, construction and modification over a property, typically granted for 50 years and renewable by mutual agreement for an equivalent term. It is distinct from full ownership, which under Abu Dhabi's older published description carries a 99-year title that does not include the land itself. Musataha is closer to a long-term right to build and use than a transfer of the land underneath.
The 10-year rule
Under Law No. 19 of 2005 as amended in 2019, a musataha holder of more than 10 years can dispose of or mortgage that right without the landowner's consent, unless otherwise agreed in the contract. Below that 10-year mark, the landowner's agreement is generally needed for such a transaction. This distinction matters if you are planning to resell or refinance before the decade is up.
Musataha's registration fee is lower than ownership's
On an off-plan sale, Abu Dhabi's DARI platform registers a musataha purchase at 1% of the sale price, against 2% for full ownership. The developer still initiates registration, still faces a 10,000 AED penalty for missing the 21-day window, and a project escrow account is still required. The lower percentage reflects the different right being registered, not a discount on the same right.

What still needs confirming at contract stage
Whether a specific unit in Abu Dhabi is sold as full ownership or as musataha is not something to assume from a project's marketing. It is confirmed on the sale and purchase agreement (SPA) and the DARI pre-registration certificate. The same applies to how long a renewal runs, and whether the contract departs from the default 10-year consent rule in either direction.

FAQ
Is musataha the same as a long lease? No. Abu Dhabi also recognises a separate long-lease regime of at least 25 years, distinct from musataha's right of use and construction. Each has its own terms, confirmed on the contract.
Can I sell a musataha right before the 10-year mark? Generally only with the landowner's consent, unless the contract states otherwise. After 10 years, the holder can typically dispose of or mortgage the right without that consent.
Why would a project be sold as musataha rather than full ownership? That depends on the land status of the specific project and is set by the developer and the land authority, not a choice confirmed here. Ask your adviser for the sourced position on any project you are considering.
Does musataha cost less to register than ownership? Yes, 1% of the sale price for musataha against 2% for ownership on an off-plan sale, though who pays that fee is still set by the SPA.
