Freehold vs leasehold in Dubai: what is the difference?

Freehold means full, transferable ownership of a unit, registered in your name at the Dubai Land Department, available to foreign buyers in designated areas. Leasehold grants long-term use rights without that outright title. Orven only presents freehold projects.

Freehold ownership in Dubai means you hold full, permanent title to a unit, registered in your name at the Dubai Land Department, which you can sell, gift, or pass on like any other asset you own outright. Leasehold grants the right to use a property for a fixed long term, often decades, without that underlying ownership transferring to you. Foreign buyers, meaning anyone who is not a UAE or GCC national, can hold freehold title only in areas the government has designated for it; outside those designated areas, foreign buyers are generally limited to leasehold or cannot buy at all.

Why the distinction matters for an international buyer

If you are buying from outside the UAE, freehold is what lets you register a title deed in your own name, resell the unit on your own terms later, and, in some cases, use the purchase toward eligibility for a Golden Visa if the investment threshold is met. Leasehold arrangements can suit specific situations, but they do not give you the same registered ownership record or the same flexibility to sell independently of a landlord's terms, since the underlying freehold typically remains with someone else throughout the lease.

Every project in the Orven selection, across Dubai Islands, Business Bay, Meydan, Dubai Maritime City and the other districts we cover, sits in a designated freehold area. That is a deliberate filter on our side: we do not present leasehold opportunities to international investors, because the ownership clarity of freehold is part of what makes a purchase from abroad straightforward to register, hold and eventually sell.

What to check before assuming a project is freehold

Not every address in Dubai is freehold, even within areas that sound similarly positioned. The safest way to confirm is to ask directly for the project's freehold status and its Dubai Land Department registration before you reserve, rather than assume based on the district's reputation. A licensed adviser should answer this immediately, in writing, without hesitation.

FAQ

Can foreigners only buy freehold in specific areas? Yes. Foreign, non-GCC buyers can hold freehold title only in areas the Dubai government has designated for freehold ownership; every project Orven presents sits within one of these areas.

Does leasehold mean I cannot resell at all? Leasehold arrangements can typically be transferred within the terms of the lease, but they do not carry the same registered ownership record as freehold, and resale flexibility depends on the specific lease structure rather than a standard rule.

Is freehold required for a Golden Visa application based on property? The property investment route to a Golden Visa is tied to ownership meeting a set threshold; your adviser and the relevant authorities confirm eligibility for your specific situation.

How do I confirm a project's freehold status myself? Ask your adviser for the Dubai Land Department registration details, or check directly with the DLD; a genuine freehold project has nothing to hide on this point.
