Freehold, Usufruct and Musataha in Abu Dhabi Explained

Four different ownership regimes can apply to a unit in an Abu Dhabi investment zone. Here is what each one actually gives you, and what it costs to register.

Two buyers can purchase a unit on the same island in Abu Dhabi and end up with two different legal relationships to the property, depending on which of four regimes applies: ownership, musataha, usufruct or a long lease. None of the four is better or worse in the abstract; each carries a different duration, a different set of rights, and a different registration fee. Knowing which one applies to your unit, and confirming it on paper rather than assuming it, is the point of this guide.

The four regimes, side by side

  • Ownership (freehold). A title that lets the holder fully dispose of an apartment or villa.
  • Musataha. A right, renewable by mutual agreement for an equivalent term, lasting 50 years, to use, build on and modify the land.
  • Usufruct. A 99-year right to use the property and its facilities, without modifying it.
  • Long lease. At least 25 years.

This description, drawn from the federal portal u.ae, predates the 2019 amendment to Law No. 19 of 2005, which strengthened the position of long-term usufruct and musataha holders specifically. The exact regime attached to a given unit is confirmed on the sale and purchase agreement and the DARI certificate, not assumed from a project's general marketing.

The 10-year rule for usufruct and musataha

The 2019 amendment to Law No. 19 of 2005 gives a specific right to anyone holding a usufruct or a musataha for more than 10 years: they can dispose of the property, including mortgaging it, without needing the landowner's consent, unless the parties have agreed otherwise. This matters for musataha in particular, since it is the regime most often attached to long-term residential developments inside investment zones. Before the 10-year mark, or if the parties have agreed otherwise, the landowner's consent may still be required for a disposal or a mortgage.

Registration fees: ownership costs more than musataha

Abu Dhabi's DARI platform charges a different off-plan registration fee depending on the regime: 2% of the sale price for full ownership, or 1% for musataha, both before a 400 AED electronic services fee and 5% VAT. This 1-point difference is one of the clearest practical signals of which regime applies to a unit, and it is worth asking your adviser to confirm explicitly rather than inferring it from the headline fee alone. Our guide on Abu Dhabi's property buying costs covers the full fee schedule, including the fees that apply at completion.

How to find out which regime applies to your unit

The sale and purchase agreement states the regime in writing, and the DARI certificate issued after developer registration confirms it formally. Developers in the current Abu Dhabi collection describe their islands in general terms, freehold and open to all nationalities for Muheira and Nawayef East according to Modon, and for Bada Al Jubail according to Jubail Island's own site, but a general statement about an island is not the same as a confirmation of the exact regime for a specific unit. Ask for that confirmation in writing before you sign.

Questions to ask your developer before reserving

  • Is this unit sold under full ownership, musataha, usufruct or a long lease?
  • If it is musataha, what is the exact start date of the 50-year term, and has the 10-year disposal and mortgage right already started to run?
  • Does the registration fee quoted match 2% (ownership) or 1% (musataha)?
  • Is the share of the project reserved for non-Emiratis under ADREC's ELMS system already filled, and does that affect this specific unit?

Why this matters more in Abu Dhabi than in a single-regime market

Dubai's freehold system applies one regime across its designated freehold areas, which simplifies this particular question for a Dubai purchase. Abu Dhabi's four regimes mean the same island, or even the same project, could carry different answers for different units, which is why confirming the regime in writing matters more here than it would elsewhere in the UAE.

Working with Orven on regime verification

Orven follows your Abu Dhabi purchase from Dubai, where brokerage is carried out through ORVEN REAL ESTATE BROKERAGE L.L.C S.P.C (Economic License No. CN-6800129, ADRA). Your adviser reads the sale and purchase agreement with you before signing and confirms the regime, the registration fee that applies, and the 10-year rule if a musataha or usufruct is involved. For the broader zone question behind this one, see our guide on whether foreigners can buy property in Ras Al Khaimah for a comparable framework in another emirate. Message Orven on WhatsApp at +971 52 776 1939 or by email at sales@orvenproperties.com with the project you are considering, and your adviser confirms the regime before you reserve.

FAQ

What is the difference between ownership and musataha in Abu Dhabi? Ownership lets the holder fully dispose of the unit. Musataha is a renewable 50-year right to use, build on and modify the land, registered at a lower fee, 1% against 2% for ownership.

How long does a usufruct last in Abu Dhabi? 99 years, under the description published on the federal portal u.ae, giving the holder the right to use the property and its facilities without modifying it.

What is the 10-year rule? Under the 2019 amendment to Law No. 19 of 2005, a usufruct or musataha holder of more than 10 years can dispose of or mortgage the property without the landowner's consent, unless otherwise agreed.

Does the registration fee tell me which regime applies? It is a strong signal, 2% for ownership against 1% for musataha, but confirm the regime explicitly on the sale and purchase agreement rather than inferring it from the fee alone.

Can I ask the developer to confirm the exact regime before I reserve? Yes, and you should. A general statement about an island being freehold does not confirm the regime of a specific unit; ask for written confirmation before signing.
